Well cheers to that. I wrote about this awful law in May (the article is linked in my profile) and the fourth circuit recently rejected it as "unconstitutionally vague" in an 8-7 decision. I don't know if that would have stood up on appeal, but on Friday the Virginia attorney general announced that the state would not be appealing. The AG rather forcefully said that the legislature should have repealed the law years ago. His office seems to have just been defending it out of obligation.
